1. Acceptance of Terms

These Terms & Conditions (“Terms”) govern your access to and use of Tukkafy (the “App”) provided by Braventa group PTY Ltd (“we”, “us”). By using the App, you agree to these Terms and our Privacy Policy.

2. Eligibility and Accounts

  • You must be at least the age of majority in your jurisdiction to use the App.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
  • Provide accurate and up-to-date information. We may suspend or terminate accounts for violations of these Terms.

3. Service Description

Tukkafy connects users with participating stores to reserve and pick up surplus food products (e.g., Surprise Bags). Availability, quantities, pricing, and descriptions are provided by stores and may change without notice.

4. Orders, Pricing, and Payments

  • When you place an order, you authorize us and our payment processor to charge the displayed amount and applicable taxes/fees.
  • All prices are in the local currency of the store unless otherwise indicated.
  • Payments are processed securely by Stripe. We do not store full card numbers or CVV.

5. Pick-up and Store Policies

  • Orders must be picked up during the specified pick-up window at the designated store location.
  • Failure to arrive within the pick-up window may result in forfeiture without refund, depending on store policies.
  • Products are “surprise” in nature and may vary. Images and descriptions are illustrative.

6. Cancellations and Refunds

  • You may cancel an order only as permitted in the App and within the time limits shown.
  • Refund eligibility is determined based on store fulfillment, pick-up compliance, and applicable consumer laws.
  • If an issue occurs (e.g., store closure within pick-up window, product unavailable), contact support at contact@tukkafy.com.

7. Acceptable Use

  • Do not misuse the App (e.g., fraud, unauthorized access, scraping, reverse engineering).
  • Do not interfere with or disrupt the App’s integrity or security.
  • Do not infringe intellectual property or privacy rights of others.

8. Intellectual Property

The App and its content are owned by Braventa group PTY Ltd or its licensors and are protected by intellectual property laws. Subject to these Terms, you are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

9. Third-Party Services

The App integrates third-party services (e.g., Stripe for payments, Google Maps for location and places). Your use of such services may be subject to their terms and privacy policies.

10. Location and Device Permissions

The App may request device permissions such as location to provide nearby store results. You can disable permissions in device settings, but certain features may not function.

11. Disclaimers

  • The App is provided on an “as is” and “as available” basis.
  • We do not warrant uninterrupted or error-free operation, nor the accuracy or completeness of store information.
  • To the maximum extent permitted by law, we disclaim all warranties, express or implied.

12. Limitation of Liability

To the maximum extent permitted by law, Braventa group PTY Ltd shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising from or related to your use of the App.

13. Indemnification

You agree to indemnify and hold harmless Braventa group PTY Ltd from any claims, liabilities, damages, losses, and expenses arising from your violation of these Terms or misuse of the App.

14. Suspension and Termination

We may suspend or terminate your access to the App at any time for conduct that violates these Terms, our policies, or applicable law, or for any other reason at our discretion.

15. Governing Law and Disputes

These Terms are governed by the laws of South Australia, Australia, without regard to conflict of laws principles. You agree to the exclusive jurisdiction of the courts located in South Australia to resolve any dispute arising out of or relating to these Terms or the App.

16. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted in the App with the updated effective date. Material changes may be communicated in-app or by email.
